4. Why Do We Need Your Explicit Consent?
Judgment of the Grand Chamber of the Court of Justice of the European Union of 1 October 2019 and AEPD Guide on the use of cookies, July 2020.
The judgment of the Grand Chamber of the Court of Justice of the European Union of 1 October 2019 states that consent is not validly given when the storage of information, or access to information already stored on the user's device via cookies, is authorised through a pre‑ticked box that the user has to untick if they do not wish to consent. Consent must be based on a clear affirmative action, through an explicit accept option, a reject option and a more information option about the cookies used.
This interpretation does not change depending on whether or not the information stored or consulted on the user's device contains personal data.
The Grand Chamber also holds that the information that the service provider must give the user of a website must include the period of time during which the cookies will remain active and the possibility that third parties may have access to the information stored by those cookies. This requirement is laid down in Directive 2009/136, which amends Article 5(3) of Directive 2002/58/EC, and in the AEPD Guide of July 2020.
How we manage your consent on this website
